Electronic Signature Consent Agreement

1. Scope of Consent

Your consent applies to all Communications related to your use of Kuditrak’s products and services, including but not limited to:

• Account agreements and disclosures
• Privacy policies and terms of service
• Transaction receipts and confirmations
• Account statements and history
• Loan agreements and repayment schedules (if applicable)
• Fee notices and updates
• Regulatory disclosures and notices

2. Electronic Delivery of Communications

All Communications will be provided to you electronically through one or more of the following methods:

• Mobile application (Kuditrak app)
• Web platform (https://www.kuditrak.com)
• Email notifications
• In-app notifications or alerts

You agree that electronic Communications satisfy any legal requirement that such Communications be provided in writing.

3. Electronic Signatures

You agree that:

• Clicking “Accept”, “Agree”, “Continue”, or similar buttons
• Entering a One-Time Password (OTP)
• Providing authentication credentials
• Using biometric authentication (where available)

constitutes your electronic signature and has the same legal effect as a handwritten signature.

4. Hardware and Software Requirements

To access and retain electronic Communications, you must have:

• A smartphone, tablet, or computer with internet access
• A supported web browser or the Kuditrak mobile application
• A valid email address
• Ability to receive SMS or OTP notifications
• Sufficient storage or ability to print documents

We are not responsible for any inability to access Communications due to failure to meet these requirements.

5. Withdrawal of Consent

You may withdraw your consent to receive Communications electronically at any time by contacting us at:

Important Notes:

• Withdrawal of consent may result in restriction or termination of your account, as electronic delivery is essential to our service
• Withdrawal will not affect the validity of prior electronic Communications

6. Updating Your Contact Information

You are responsible for keeping your contact information (email address, phone number) up to date.

Failure to update your contact details may result in missed Communications, for which Kuditrak shall not be liable.

7. Requesting Paper Copies

You may request a paper copy of any Communication by contacting us at:

Kuditrak reserves the right to charge a reasonable fee for providing paper copies.

8. System Integrity and Security

Kuditrak implements industry-standard security measures, including:

• Encryption of data in transit and at rest
• Secure authentication mechanisms
• OTP verification for sensitive transactions

However, you are responsible for maintaining the confidentiality of your login credentials and devices.

9. Consent to Electronic Records

You acknowledge that:

• Electronic records will be stored and retained by Kuditrak
• These records are admissible in legal proceedings
• Electronic records may be used as evidence of transactions and agreements

10. Changes to This Agreement

We may update this Agreement from time to time. When we do:

• We will notify you via email or in-app notification
• Continued use of Kuditrak constitutes acceptance of the updated Agreement

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, including applicable electronic transaction and data protection laws.
